General terms and conditions
Leinen von Klee with Chamber of Commerce (KVK) number 7799847, registered at Turfbergerhout 37, 3845JP Harderwijk (The Netherlands). These general terms and conditions apply to all purchase and sales agreements concluded by Leinen von Klee and its customers via leinenvonklee.com, all its sub-domains as well as purchases initiated via social media platforms (e.g. Instagram). No agreement can be created without your agreement to these terms and conditions. By placing an order with Leinen von Klee via any channel of communication the customer declares to fully and completely accept these terms and conditions. The customer acknowledges to have read these termns and conditions prior to his/her order. Leinen von Klee cannot guarantee that the content of the site and social media is always free of typographical errors and/or inaccuracies or fully up to date at all times. Leinen von Klee is entitled to change the content of the site and these terms and conditions at any time. For an individual purchase the terms and conditions on the order date apply.
Product Information
The colors on your screen may differ from those of the original product. This depends on, among other things, your device settings. We make every effort to display the correct colors on our webshop and to describe the product and it’s characteristics in the most accurate way. We do not accept returns based on color nuances.
Ordering & Availability
Leinen von Klee is likely to change its range of products at any given time and stock levels may fluctuate according to levels of sale. Leinen von Klee frequently updates product availability information but will not be held liable if the stock or product is no longer available, regardless of the reason. In this case Leinen von Klee will inform the customer and offer the choice of either an alternative product or full refund. No other compensation for cancellation may be requested other than the full refund.
Prices and Payment
All prices may be subject to change and in the EU include the Dutch VAT of 21%. Prices are applicable on the day of the order. All other countries are without VAT. It is within your responsibility to pay the appropriate VAT of the receiving country if we ship outside of the EU. We accept payments via PayPal, Klarna and bank transfer. All articles of an order must be paid in full prior to shipment and remain in the ownership of Leinen von Klee until the full payment, including shipping costs has been received. Amounts paid can not be considered as deposits or advance payments. Shipments will be initiated when payment is confirmed by PayPal, Klarna or when the bank transfer has been executed. Leinen von Klee reserves the right to cancel an order if the amount is not received in full and within 5 working days of placing the order or if information is incomplete.
Delivery
You will receive a confirmation after placing your order. You will receive a second confirmation when your payment is completed. After your order has been dispatched, you will receive a tracking number by e-mail. Delivery time commences as soon as Leinen von Klee has received payment from the customer. All orders are dispatched within 1-5 working days after receipt of payment. Leinen von Klee can not be held liable for the non fulfilment of the contract / delivery if this is due to an act of a third party or force majeure.
Returns policy & Refund
You may return an item within a seven-day period starting on the day after the item’s delivery. The seven-day period includes non-working days and public holidays. Thereafter Leinen von Klee will assume the customer is satisfied with the order. An item to be returned must always be reported with an unambiguous email sent within the seven days of delivery and the article must be sent in accordance with the return’s procedure below as otherwise the refund may be delayed. The items must be delivered to our return address within seven days of the request to return the items concerned. If the items are not delivered within the seven days of the request Leinen von Klee will assume the customer has changed his/her mind and is satisfied with the order and no longer wishes to return the items. We advise you to provide the return shipment with a tracking number. The goods must be sent back to us in perfect condition, cleanliness and in the original box and packaging including all accessories. They must not be worn, washed or have suffered any kind of deterioration and all labels must be intact and affixed. Leinen von Klee will accept returns and offer a refund only if all afore mentioned conditions are true. Leinen von Klee is not responsible for any damage, theft or loss during the return shipping and will only refund when the item is received at Leinen von Klee. Defective items may be exchanged for the same type of product in the same color and size, subject to availability and if the defect is confirmed to be an original defect. Refunds for returns or defective items will be effected within 30 days of receipt of the return shipment. Refunds never include cost of initial and return shipping. The only exception is if the item has a confirmed original defect in which case Leinen von Klee will cover the initial shipping cost, the cost of the item and the return shipping cost up to a maximum of the price of the initial shipping cost. Customers that wish to make a complaint should always first contact customer service at leinenvonklee@gmail.com. Items may only be returned by post to our return address: Turfbergerhout 37, 3845JP Harderwijk, The Netherlands.
Guarantee
The customer is expressly informed that Leinen von Klee is not the producer of the products presented within the framework of leinenvonklee.com. Thus in the event of damage or injury to a person object by a product defect the customer may only seek redress from the manufacturer. We strive to deliver high quality and safe products. However the products, its accessories, features and the quality of the products in no way substitute the requirement of constant vigilance of adults relating to the use of the products and accessories. It is the customers / guardians responsibility to immediately remove a product from use when a defect or possible defect has been identified until it has been corrected. Leinen von Klee will not be held liable for non-compliance with the legislation of the country to which the products are delivered to and it is the customers responsibility to check with the local authorities regarding the use and import of the products he/she intends to order.
Liability
Leinen von Klee strives to ensure the products and services comply with applicable laws. However it is the customers responsibility to verify with the local authorities with regards to the possibilities of importing and using the products which he/she intends to order. Leinen von Klee will not be held liable for non-compliance to the legislation of the country into which the product is delivered and/or where it will be used. Leinen von Klee can not be held liable for inconveniences and damages relating to the use of the Internet, including a break in the service, the presence of computer viruses and/or external breaches and, more generally, all events of force majeure or caused by third parties. Hypertext links may direct users to sites other than the website leinenvonklee.com. Leinen von Klee accepts no liability in the event that the content of these sites contravenes the legal and regulatory provisions in force. The company shall not be held liable for any direct and indirect damages which may arise from the purchase of the products. In the same way, with regard to the obligations of these General terms and conditions, Leinen von Klee shall not be held liable in the event of the occurrence of an event of force majeure
Force Majeure
In the event of force majeure, Leinen von Klee is entitled to dissolve the agreement between Leinen von Klee and the customer. Force majeure includes a transport standstill or serious hindrance at Leinen von Klee and/or its suppliers and security breaches on its website by third parties.
Intellectual property
This website and all sub-domains are the intellectual property of Leinen von Klee. Nothing may be copied or used without Leinen von Klee’s permission.
